This litigation has been designed to fail. Maxwell was under-charged. She will plead, give up some of her riches, serve 3 years, and the rest will be buried. It’s all right there, in black and white, in the Superseding Indictment pregnant with the embryo of its own destruction.
The first indictment was 18 pages, the corrected version is 24 pages, and as a lawyer of 27 years who read and wrote pleadings every single day, I assure you this thing should have been hundreds upon hundreds of pages long and rich with detail, one fact per numbered paragraph. Even the indictment Acosta allegedly drafted was reportedly more than 80 pages. You can already see where this is going. I have had to answer a longer Complaint in a slip and fall case.
Epstein got a plea deal in Florida that arguably covers all his accomplices through 2007. The federal indictment against Ghislaine stops at either 2002 or 2004. It is so poorly drafted that it’s not clear. This badly written indictment fails to even give all the relevant dates to do the required legal analysis. I would not have accepted this level of workmanship from a law clerk.
There are serious statute of limitations issues in these older charges. Records are gone. Witnesses are scattered. With the hundreds, maybe thousands of victims, could they not find one person whose accusations are not possibly time-barred? Of course, they could have. But they didn’t. Even when they had a second chance to do so.
Dershowitz waves around the 2007 plea deal. So the feds revise the indictment. They went back to the grand jury to add some perjury charges from some depositions in 2016, along with a demand for forfeiture. But no recent sex abuse charges.
Federal perjury has a 5-year max. Interstate prostitution, section 2422, 10 years. Transporting minors, section 2423, 15 years. Why wasn’t she charged under RICO for a max of life? Or Section 1581 human trafficking – life? Why only four victims? Why nothing from 2002 on?
If historians dug this up in 500 years, they’d never guess that anybody other than Epstein and Maxwell had anything to do with raping children. There’s not a whisper, not a pronoun, not a shoelace belonging to anybody else. An international sex trafficking ring is reduced to one perverted couple.
Maxwell will file more motions to have the sex abuse charges tossed based on the lapse of time. The appellate court will do a Cosby. Time served.
The entire thing is getting buried – again – in real time before our eyes. The End.
